J. Gerald Smith, an 82-year-old Uber driver from Florida, was on his way home to have dinner with his wife Wednesday when police say a speeding yellow Lamborghini slammed into his Buick SUV, killing him.
The fatal collision took place on Northeast 6th Avenue in Delray Beach at 4.36pm on the 21st of September. Investigators say the driver of the luxury sports car, 60-year-old fitness chain founder Roger Wittenberns, was injured in the accident and remained in serious condition at Delray Medical Center Thursday.
Wittenberns’ girlfriend,
61-year-old Patty Ann McQuiggin, was also present at the scene of the crash but left in her Porsche and has refused to make a statement to police. Her vehicle was not involved in the collision.

Wittenberns was hospitalized with serious injuries, telling police he and his girlfriend had spent the day eating and drinking

Officers spoke to McQuiggin briefly at her home in Vista Del Mar Wednesday.
Wittenberns, who police say has been cooperative with the investigation, told officers from his hospital bed that he and McQuiggin had spent Wednesday afternoon eating and drinking in downtown Delray Beach, and after lunch left the area in separate vehicles – he in his yellow Lamborghini and she in her matching yellow Porsche.
Witnesses say that just before the crash, both vehicles were seen speeding north on Northeast 6th Avenue, where the speed limit is 35mph. It is unclear at this time how fast the Lamborghini was going.
J. Gerald Smith had come to a stop sign on Northeast 1st Street and was heading west across Northeast 6ht Avenue when the Lamborghini slammed into the driver’s side of his Buick Enclave.
According to police, McQuiggin immediately took off from the scene in her Porsche and abandoned it outside a restaurant just feet away from the site of the crash.
